Compliance Corner: What Are the Chances?

Did you know the “Energy Bill” includes provisions for Underground Storage Tank (UST) facilities under Title XV, Subchapter B that you should be aware of? 

  1. Increase inspections - Within two years of final adoption, all registered UST facilities that have not been inspected by December 22, 1998, will be inspected and all facilities once every three years thereafter. 
  2. Training – Within two years of final adoption, a training program will be developed that will require operators who are in day-to-day control of the facility to show they are knowledgeable in the operation of a UST system. 
  3. Enforcement – Funding will be made available to provide additional personnel to implement the enforcement process as needed as a result of the increased number of inspections and violations found. 

Where does the funding come from to implement this new program? It comes for the Leaking Underground Storage Tank Trust Fund. So what are the chances that your facility will be inspected? Once the final revisions are completed and implemented, 100%!
